HOSPITALITY PURCHASE TERMS & CONDITIONS

Hospitality tickets will be issued at the discretion of Kennington Oval Limited (KOL) and its authorised agents on the following terms and conditions (the “Terms and Conditions”).  Any person who purchases, possesses or attempts to use a hospitality ticket issued under these Terms and Conditions (“Ticket(s)”) shall be deemed to have accepted and agreed to have complied with these Terms and Conditions:

1. DEFINITIONS

In these terms and conditions, the following words shall have the following meanings:

  • KOL” means Kennington Oval Limited or Oval Events Limited.
  • Customer” means the purchaser of the hospitality package.
  • Package” means the complete hospitality package to be sold to the customer by KOL which may include without limitation; a ticket to the event together with catering at the event within the facilities at or in the vicinity of the venue.
  • Event” means the event to which the package relates.
  • Venue” means the Kia Oval.
  • Price” means the price of the package detailed on the invoice or as otherwise notified by KOL in writing.
  • Deposit” means the deposit payable as detailed on the invoice or as otherwise notified by the seller in writing.
  • Contract” means a legally binding contract made in accordance with Condition 2.

The headings in these conditions are for convenience only and shall not affect their interpretation.

Any reference to any provision of a statue shall be constructed as a reference to that provision as amended, re-enacted or extended at the relevant time.

Where the context dictates in these conditions, the singular shall include the plural and vice versa and any gender includes the other gender.

2. BOOKING AND PAYMENT

Making a Booking:

  • All Hospitality Packages are subject to availability and these Terms and Conditions, together with the Kia Oval Ground Regulations.
  • A booking becomes legally binding when the customer receives a booking confirmation or invoice from KOL, or when KOL receives the required deposit or full payment.
  • Bookings remain provisional until all outstanding payments have been received. Tickets and event documentation will not be issued until the balance has been paid in full.
  • KOL reserves the right to correct any typographical, clerical or administrative errors contained in marketing materials, quotations, invoices, price lists or other documentation without incurring liability.
  • KOL may make reasonable changes to the content, location or delivery of a Hospitality Package where operational requirements make this necessary, provided that such changes do not materially affect the overall experience.

Payment Schedule:

  • Bookings made more than 12 weeks before an Event
    • A 50% deposit must be paid within 10 working days of the invoice date.
    • The remaining balance must be paid no later than 12 weeks before the event.
    • Deposits are non-refundable except where otherwise stated in these Terms and Conditions.
  • Bookings made within 12 weeks of an Event
    • Full payment is required at the time of booking.
  • Bookings made within 7 days of an Event
    • Full payment must be made using an authorised credit card.

Additional Charges:

  • Any additional products, services or upgrades requested by the customer that are not included within the original Hospitality Package must be paid for in full at the Event using an authorised payment method, unless otherwise agreed by KOL.

Failure to Pay:

  • If payment is not received by the date specified on the invoice, KOL reserves the right to suspend or cancel the booking and withdraw any associated Hospitality Packages.
  • Where reasonably possible, KOL will provide the customer with 24 hours’ written notice to remedy any payment default before taking such action.
  • Cancellation of a booking due to non-payment does not affect any other rights or remedies available to KOL under these Terms and Conditions or by law.

Booking Through Approved Resellers:

  • Hospitality Packages purchased through a third-party reseller may also be subject to that reseller’s terms and conditions.
  • To guarantee valid entry to the venue, customers should only purchase Packages through KOL or an officially authorised reseller. KOL cannot guarantee the validity of packages purchased through unauthorised sellers.

3. CHANGES, CANCELLATIONS AND RESCHEDULING

Changes to your package:

  • KOL will use reasonable endeavours to deliver all Hospitality Packages as described at the time of booking.
  • However, operational requirements may occasionally require changes to the location, facilities, content or delivery of a Hospitality Package. KOL reserves the right to make such changes, including relocating hospitality facilities within the Venue, provided that the overall quality and value of the experience are not materially affected.
  • Where necessary, KOL may offer alternative facilities or arrangements of a comparable standard.

Match Rescheduling and Venue Restrictions:

  • If an Event is rescheduled, moved to a different date, or required to take place behind closed doors, KOL will notify customers as soon as reasonably practicable via email and through the Kia Oval website.
  • If a customer is unable to attend the revised Event date, or the Event is played behind closed doors, they may cancel their booking by contacting hospitality@kiaoval.com within five days of the announcement.
  • Where a cancellation is accepted under these Terms and Conditions, any applicable refund will be processed within 30 working days.

Booking Ownership:

  • All bookings, tickets and related hospitality entitlements remain the property of KOL at all times and may be withdrawn, cancelled or amended in accordance with these Terms and Conditions.

Meetings & Matchday Packages:

  • Meeting & Matchday Packages combine a meeting element with matchday hospitality and are governed by these Terms and Conditions. The same booking, cancellation and refund provisions apply unless otherwise stated.
  • The meeting element will proceed as scheduled regardless of adverse weather conditions or whether play takes place, except where circumstances beyond KOL’s reasonable control prevent delivery of the service.
  • Where a cancellation is permitted under these Terms and Conditions, KOL reserves the right to offer a credit note for the eligible amount. Any credit issued may be used towards an alternative equivalent fixture or event during the current or following season.

4. REFUND POLICY

  • Except as expressly set out in these Terms and Conditions, all package bookings are final and all payments made by the customer, including deposits and final balances, are non-refundable.
  • In the event of a match being cancelled due to inability to admit spectators, and is not rescheduled, KOL will refund the customer.
  • In the event of play being curtailed or abandoned due to adverse weather, or where a match finishes earlier than scheduled because a result has been achieved, ticket-price refunds shall only be payable in accordance with the below refund terms:
    • INTERNATIONAL MATCHES: If play is restricted or does not take place at the ground on the day for which your hospitality package was valid, you will be issued a refund equalling the face value of the highest general admittance ticket price only for that particular event.     • DOMESTIC MATCHES: If play is restricted or does not take place at the ground on the day for which your hospitality package was valid, you will be issued a refund equalling the face value of the highest general admittance ticket price only for that particular event.   • Meeting and Matchday:
    • Any refund entitlement relating to the matchday element shall apply in accordance with these Terms and Conditions.
  • ICC Events:
    • This KOL hospitality refund policy should be read in conjunction with the relevant policy specific to the ICC event in question.
    • The purchaser acknowledges and agrees that neither the venue (or Authorised Agent if applicable), nor the host, IBC or ICC shall have any liability relating to the interruption, suspension or cancellation of play at any match related to the event.
    • In the event of cancellation or curtailment of play due to adverse weather, the customer shall automatically be entitled to a refund of the face value of the general admission ticket element of the hospitality package only (calculated by reference to the face value of the highest category of general admission ticket for the event).
    • The venue (or the Authorised Agent to the extent that the customer purchases the package via an Authorised Agent) shall effect any refund or reimbursement which may be due to the customer in accordance with the following refund policy (please note that the applicable amount will be refunded within 60 days of the date of the affected event):
      • Single Match Day:
        • If 0 – 9.5 overs are played on the day for which the ticket is valid and no result is obtained, an automatic full refund of the face value of the highest category of general admission ticket for the event (excluding any booking fees) will be made to the original credit or debit card used by the purchaser to make the purchase of the ticket(s).

5. CUSTOMER RESPONSIBILITIES

Customer Default:

    • Commits a material breach of the Contract that cannot be remedied.
    • Commits a material breach of the Contract that can be remedied, but fails to do so within 10 days of receiving written notice from KOL.
    • Enters into an arrangement with creditors, becomes insolvent, is subject to bankruptcy proceedings, or has a receiver, administrator or similar officer appointed.
    • Ceases, or indicates an intention to cease, trading or carrying on business.
    • Is declared bankrupt.
    • Fails to pay the outstanding balance in full when less than eight weeks remain before the Event.KOL reserves the right to suspend or terminate the Contract, without affecting any other rights or remedies available to it, if the customer:
  • In these circumstances, KOL may cancel the booking and withdraw any associated Hospitality Packages.

Liability for Guests and Damage:

  • The customer is responsible for the actions and behaviour of their guests, employees, agents and contractors attending the event.
  • The customer agrees to indemnify and hold KOL harmless against any claims, losses, damages, costs, liabilities or expenses, including reasonable legal costs, arising from:
    • Any act or omission by the customer or their guests.
    • Any breach of these Terms and Conditions by the customer or their guests.
    • Any loss, damage or injury caused to KOL, the Venue, its employees or other attendees.
    • Any damage caused to the Venue, facilities or property by the customer or their guests.

Safeguarding:

  • The customer is responsible for ensuring appropriate safeguarding arrangements are in place for any children, young people or adults at risk attending or participating in an event. This includes responsibility for:
    • Carrying out any necessary safeguarding risk assessments.
    • Providing appropriate supervision and duty of care throughout the Event.
    • Managing the conduct and welfare of individuals within their group whilst using the Venue’s facilities.
    • Providing KOL with any relevant accessibility requirements, medical information or allergen details in advance of the Event.
  • The customer remains responsible for the safety, supervision and wellbeing of their group at all times whilst attending the venue.

6. VENUE RULES & GUEST CONDUCT

Venue Conditions & Obligations:

  • The customer is responsible for its guests and will procure that its guests comply with these Terms and Conditions (where relevant) and with any rules, regulations and directions set down by KOL, without limitation, any and all conditions of sale applicable to tickets.
  • The customer will not resell or otherwise transfer or offer for sale or transfer any part of a package without the prior written consent of KOL. The customer will not use any or part of a package (including, for the avoidance of doubt, any tickets) as prizes in competitions, sweepstakes, raffles, draws or for other similar commercial, promotional or marketing purposes without prior written consent.
  • The customer will not display any signage, promotional material or other such items anywhere at the venue without KOLs prior written consent.
  • The customer shall be responsible for ensuring the good and orderly behaviour of its guests whilst at the venue and shall ensure that any person behaving in an unruly or abusive manner shall leave the venue if requested to do so as per the Kia Oval’s Ground Regulations.
  • Any breaches of the Terms and Conditions, KOL withhold the right to terminate the contract without refund to the customer.

Venue Rules:

  • The venue does not permit smoking and vaping within the main bowl. The customer is permitted to smoke in dedicated areas only and failing to comply may result in ejection.
  • The venue has a zero tolerance policy on drugs. Anyone found using or in possession of drugs will be ejected and may be handed over to the police.
  • The venue operates a Challenge 25 policy and ID will be required for service of alcohol. The venue has the right to refuse clients service, as well as ejecting those that are deemed intoxicated.
  • KOL will not tolerate any abuse towards staff or other guests. Any person who makes abusive or threatening comments, or who acts in an inappropriate manner is subject to ejection.
  • Hospitality bars will serve up to 30 minutes after the close of play, with all facilities closing 1 hour after close of play.

General Guest Information:

  • Under 18’s are welcome in all hospitality areas for domestic matches, but must be accompanied by an adult and will require a ticket. Under 2’s are classed as free. Clients are kindly asked, where possible, not to bring pushchairs into the venue due to a lack of storage capacity.
  • It is the customer’s responsibility to ensure all dietary requirements are supplied to the venue no later than two weeks in advance of the fixture, however, KOL does not guarantee that any food or drink products are free from allergens.
  • Any property left at the venue is left at the owner’s risk.
  • The customer agrees to inform KOL staff on the day of any issues and KOL, where possible, will aim to rectify issues on the day.

7. LIABILITY & EVENTS OUTSIDE OUR CONTROL

Warranties & Liability:

  • Except where required by law, and subject to these Terms and Conditions, all warranties, conditions and other terms implied by statute or common law are excluded to the fullest extent permitted by law.
  • Where a package is purchased by a consumer, nothing in these Terms and Conditions affects the customer’s statutory rights.
  • If you have any concerns or complaints regarding your package, you should notify KOL in writing as soon as reasonably practicable following the event.

Limitation of Liability:

  • To the fullest extent permitted by law, KOL will not be liable for any indirect, consequential or special loss arising from, or connected with, the package or the contract. This includes, but is not limited to, loss of revenue, loss of profits, loss of business opportunities or loss of anticipated savings.
  • KOL’s total liability to the customer, whether arising in contract, negligence, tort or otherwise, shall not exceed the total amount paid by the customer for the package under the relevant contract.
  • Nothing in these Terms and Conditions excludes or limits KOL’s liability for death or personal injury caused by its negligence, fraud, or any other liability that cannot be excluded by law.

Force Majeure:

  • KOL will not be liable for any delay in performing, or failure to perform, its obligations under these Terms and Conditions where such delay or failure results from circumstances beyond its reasonable control.

    These circumstances may include, but are not limited to:

    • Severe weather conditions, flooding, fire, explosion or other natural events;
    • Acts of God;
    • War, armed conflict, terrorism or threats of terrorism;
    • Civil unrest, riot, sabotage or public disorder;
    • Government action, legislation, regulations, restrictions or embargoes;
    • Industrial action, strikes or labour disputes;
    • Failure of utilities, power supplies or communication networks; and
    • The postponement, suspension, abandonment or cancellation of an Event.

    In such circumstances, KOL shall not be considered in breach of these Terms and Conditions and will not be liable for any resulting loss, damage or expense incurred by the customer.

8. LEGAL AND COMPLIANCE

General:

  • Nothing in these Terms and Conditions or the Contract shall be deemed to create a partnership, joint venture, agency or employment relationship between KOL and the customer. Neither party has the authority to enter into agreements or assume obligations on behalf of the other party.
  • A person or organisation who is not a party to the Contract shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision of the Contract or these Terms and Conditions.
  • KOL will use the information provided by the customer to administer and fulfil the purchase. By purchasing a Hospitality Package, the customer agrees that KOL may contact them with information about future fixtures, events and relevant venue updates, in accordance with applicable data protection laws.
  • These Terms and Conditions, together with the Contract, shall be governed by and construed in accordance with the laws of England and Wales. The parties agree to submit to the non-exclusive jurisdiction of the English courts.

Legal & Compliance:

  • KOL is committed to operating responsibly, ethically and in full compliance with all applicable laws and regulations. This includes, but is not limited to:
    • The Bribery Act 2010 and all applicable laws, regulations and guidance relating to anti-bribery and anti-corruption.
    • The Equality Act 2010 and all applicable laws, regulations and guidance relating to equality, diversity and anti-discrimination.
    • The Modern Slavery Act 2015 and all applicable laws, regulations and guidance relating to modern slavery, human trafficking and ethical business practices.
  • KOL expects its employees, suppliers, contractors and business partners to uphold these standards and to operate in a manner that supports fairness, integrity and respect for human rights.
